Legal Question in Real Estate Law in Georgia

I closed on a home in a new subdivision in Gwinnett County, GA 7 months ago and it has become increasingly obvious that one of the two existing trees in the back yard is dead (and obviously was when we closed on the property). The builder does not include landscaping in their warranty, but does that mean they have no accountability for having removed this dead tree?
