Legal Question in Real Estate Law in Georgia
What can coffee county georgia legally take to widen a county road without giving the property owner prior notification. Is there a certain footage amount allowed without the property owners consent?

Coffee County cannot take any of your land by condemnation: (i) without proper notice to you, and (ii) without paying you "just compensation." The fight in these issues is usually how much money equals "just compensation." At the end of the day, the County will typically get to take as much land as it reasonably needs to meet the public need. If you are concerned about how much land you are using and/or the price the County is offering to pay for such land, I would recommend that you hire a Georgia attorney immediately to negotiate with the County on your behalf. If the County is unwilling to negotiate, that attorney may need to file an injunction against the County requesting the Court to stop the taking altogether.
Best of luck. ******* The above does not create an attorney-client relationship and is instead intended solely for informational purposes.*******
Phillip's answer is correct but incomplete.
You need to check and be sure the county has not already acquired the right of way, perhaps before you purchased.
