Legal Question in Real Estate Law in Georgia
Condo Association Insurance Responsibilit
In Jan 2001 I purchased a condo based on representations by a seller that the home was in good condition as well as a home inspection. In particular, I was told that a new roof was just installed the December prior. February of this year the roof leaked and damaged many of the ceilings and personal property. I informed the association and several times the roof had to be repaired because each time the roof was not repaired correctly. I turned a claim into my home owner's insurance for the damage. In addition to the roof leaking, there was another incident from the faulty plumbing at the association did not maintain and subsequently it flooded my home and also caused and additional claim against my insurance. I notified my home owner's association's insurance company but they disclaim any liability. Now my insurance has refused to continue coverage due to many claims in one period. What can I do with the association? I am entitled to damages from them. I don't know how I can obtain homeowner's coverage now that I have been canceled from another company?

You should have a local attorney review the policies as well as the HOA docs to see if they provide you any help.
