Legal Question in Real Estate Law in Georgia

New condo false advertisement & design issue

We have bought a condominium in the city of Chamblee. We bought it before it was finished and had been told that our concerns would all be handled, such as cracking concrete floors, un-insulated pipes and sound. Excessive noise, I can hear cats scurrying, chairs dragging, coat hangers dropping and people walking. We can also hear people urinating in the toilet and flushing. I can hear water running down all of the pipes. The builder has told us there is no insulation between our ceiling (which consists of a corrugated sheet metal) and the concrete slab floor above. Our AC is also wide open and hangs on an elevated area over our bedroom. The noise levels are so loud I believe we are actually loosing hearing sensitivity. Many of the neighbors have complained to the developer, which actually lives in the building. He has blown everyone off and threatened the most vocal ones with malicious slander lawsuits. I also believe misrepresentations have been made to sell the units (100 in total). They advertised there was a pool and it turns out to be a lap pool etcetera.

Please let us know if there is any legal recourse in this matter. I feel we have been robbed and we are miserable in this home. Help?

Re: New condo false advertisement & design issue

The buyers should get together and discuss their options as to the defective construction issues. It sounds like you need to retain an attorney as a group. You didn't say whether you had a home warranty or not, this would help. There has been a lot of activity in recent years regarding defective condos so there is some precedent out there. As far as misrepresentations, you should always beware when buying houses and cars and do all your homework and don't take the sellers word. You will almost always be disappointed.
