Condo Leasing
I own a condo and my job transfered more 50 miles from the city I live in. Our cap rate is 10% and the Board is saying that I need to be on a waiting list but accordgin to our deckaration I fall into a ''hardship'' situation which should be evaluated and allow me to lease. Can the Board really control this situation even though I have good reason to want to lease? Would this hold up in court?

You mention a "declaration" about hardship but don't tell us what it says, and yes, the Condo Board have a lot of power, as contained in the relevant documents. This is something that should be considered when purchasing a condo.
