Legal Question in Real Estate Law in Georgia

contract fraud by mortgage holder

refinance of mortgage to get away from a company, paid a

prepayment penalty to do so. resulting in the mortgage being immediately flipped back to the same company. defrauding us of over 5600.00 in prepayment penaltys.

It was never disclosed to us that the new company we

were going with was a division of the same company we were

trying to get away from. At closing by the attorney used

by the mortgage company, we never received a copy of the

contract, indeed we were told the one we had signed was

not correct, and we would have to come back in and sign

a new contract, this also never happened, the lawyer in

question is now dis barred. the contract we agreed to was

to be a fixed rate, the contract the mortgage company is

holding is a variable, the contract was altered after

the fact. pages from the first and second contract being

combined. the mortgage has been moved 4 times since then

every time we attempt to correct this, a new service

company appears. our position being we have no contact at

all. i do not have a lot of money to hire a lawyer, and

must file a suit. Please advise me as to how to file same.

Re: contract fraud by mortgage holder

Your case sounds very complex and it would be pretty much impossible to write you an e-mail and tell you how to file a proper lawsuit. I would consult with a local attorney. It is possible that they might be able to take your case on a contingency.

If you would like to discuss any issues further, please feel free to contact my office. My contact information is below. Thank you.
