Legal Question in Real Estate Law in Georgia

I have a contract for a house and put up $500.00 in earnest money; we couldn't close based on some credit challenges, however, the selling agent and the mortgage agent told me to leave the earnest money on the contract and we could close when I filed my taxes for 2010. My agent called me two weeks ago and asked if I had received my earnest money, because they agent had sold the house. Do I have any legale recourse?

No one here can tell you (although probably not).

Your right to get (or lose) the deposit depends completely on the one thing you did not tell us - what the contract says. (Nothing the agent told you matters).

Look at your contract to determine your rights. (If you did things right and saw a lawyer before signing, you would have added language to cover this possibility).
