Legal Question in Real Estate Law in Georgia

Contract/Timeshare Transfer

I signed a contract with a timeshare company to transfer the timeshare out of my name to theirs. It was a year ago and it still has not been done. They have been giving me excuse after excuse as to why it is not done yet. I did pay them for this to be done (I know you are never supposed to pay but I checked on the BBB before I decided to go with them and they had a good rating and no complaints so I went for it hoping for the best) and they gave me a gift to a travel agcy for me to use. The travel agcy and old transfer company backed out of the deal in Aug 08 bc of shady services on the transfer company's side so now I have given them money and they have given me nothing. They went to a new transfer company in Fl and we had to do the paperwork all over again. We did have to sign a limited power of attorney so the transfer company will be able to finish the transfer and we had all paperwork notarized. The new paperwork was sent in Nov. 08 and I was told it should take 8-10 wks for the transfer to be completed. It is now Feb and I called the transfer company to see if my transfer was done and they are saying that they are still waiting for paperwork. Can I tell them that I want to keep my timeshare and not transfer?

Re: Contract/Timeshare Transfer

You refer to contracts and paperwork that govern these matters. We do not have them. Read them to see if they answer your questions, or have a lawyer review them.

Your questions are very difficult without reviewing the pertinent documents. Consult with a local attorney.
