Legal Question in Real Estate Law in Georgia

Can the county take part of my property without permission?

The county is taking the dirt road and making it paved. However without asking they have taken 4 ft x 150ft worth of--name removed--property with--name removed--trees. Can they do this without permission? Do they have to compensate--name removed--and--name removed--husband?

Re: Can the county take part of my property without permission?

Perhaps. Usually a right-of-way includes an easement along the frontage for clearing or maintenance. The right-of-way deed would need to be reviewed before a definitive answer could be given.
