New Covenants
Our neighborhood's covenants automatically expire in 2009 due to the developer not providing a provision to amend or extend. Our homeowner's association had new covenants and by-laws written up and proposed them to our members. 51% of them signed them. The HOA filed them with the county on Dec 12, 2005. Two of the neighbors that signed the new documents sold and closed on their homes in Nov. 2005 one month before the documents were filed. The new owners never signed the documents. Since the new documents were not filed with the county until after the sale of the homes, are these documents binding to the new neighbors or are they still under the original documents?
