Legal Question in Real Estate Law in Georgia

deceased father left no will

I am one of 6 siblings. Our parents have been divorced 40 years. Our dad passed away 4 years ago leaving 77 acres and no will. We have never been able to come to an agreement with our step-mom as to how and when the property should be divided. She refuses to cooperate and we have procrastinated about taking legal action since in all liklihood she would contest it. She has already had timber cut without our consent. In order to pay the property taxes she leases the land to hunters. To what portion are we legally entitled and what actions would be most economical and beneficial in acquiring it? We are all residents of Tennessee and the property is in Georgia.

Re: deceased father left no will

If you have waited four years, it is time to get a lawyer (preferably one who handles these cases in the county in which the property is located and/or estate administered).
