What degree of care is required? What liability?

My house and the one next door were built at the same time 5 yrs ago.

In digging holes for plants near property line I found that both our phone lines come in from the street 3' inside my property with 'his' Y'ing off to his house 50 ft from the street.

I will be removing existing plants and also planting some young trees in the area where his line takes a turn for his property, this is pretty close to where I am going to plant and I wonder what liability I would have if the line to his place is damaged in planting or later the watering or the tree roots have an adverse affect on his phone line.

Should I give him a heads up about the phone line placement and coming work I plan or should I just go ahead and hope it all works out?

He would not know the placement of the lines as he purchased from original owner 13 months ago. Probably even the original owner didn't know the lines shared the same trench from the street.
