Legal Question in Real Estate Law in Georgia
Due on sale issues
First question is do I need a FL or GA attorney for this? I have a mortgage on a home in GA. I stupidly allowed myself to get into a ''due on sale'' contract. I hired an attorney and tried to get out of the contract but was advised by the attorney I had no choice. The ''investor'' who has the warranty deed on this property has made the last three payments late, but less than 30 days. He is not abiding by the contract. I am concerned my credit rating is at risk. I tried to get a time limit placed on this contract but my attorney wouldn't do it. The mortgage is also a VA loan. There are more details, but in a nutshell, how can I make this investor purchase this property and rid myself of the mortgage in my name?
