Easement

I own a piece of property in colquitt county.My sister in law owns the adjoining property. We give easment to a church and cemetary in the form of a dirt road that is approimately 350 feet long. My problem is the county gets a call from the preacher of the church on a regular basis saying come trim the trees and scrap the road to the church. We have asked them on numerous occaisons not to cut our trees instead they say they have the right to because they own the road. The problem is we pay taxes for this road in our property taxes so how can they own the road we have not released it to them?

Re: Easement

Based on the facts in your question, you gave the Chruch (and its Cemetary) and easement. They have the right to keep the easement clear for use, within reason. (Could be a big fact fight here, but you dont indicate that). It would seem the Church and County are within their rights. HCW
