Legal Question in Real Estate Law in Georgia
End of lease, mgmt forgets to give new lease
My apartment lease expired at the end of July. Throughout June and July I repeatedly asked the management team for a new 12mo. lease but they kept giving me 6mo. leases. Now it is the end of August and I still do not have a lease to sign. I believe the management team has dropped the ball on this one, which is the typical pattern of this apt. complex. My lease talks of 60 days renewal notices, but no where does it speak of automatic renewals. Because the mgmt team has forgotten about the renewal and the previous lease has expired, can I wiggle out of the 60-day renewal and give them a 30-day notice? Do I have any rights since there is no signed contract for the coming year??

Re: End of lease, mgmt forgets to give new lease
I cannot tell completely whether you are out of a new lease, because some facts are missing from your question. However, is appears that there is no 12 or 6 mo lease in effect. Given the fact that they are so disorganized, I doubt they will stand on their rights concerning the 60 day renewal provisions. Give them the heave ho and move somewhere else.
