Ex-fiance won't agree to sell our home. What are my options?
My fiance and I broke up. We own a home together. I wanted to sell the home and split the money equally but my fiance refused to do so. Things got ugly between us so I moved out. This was 7 months ago and my fiance still refuses to sell. What are my options when I want to sell and my fiance doesn't?

Your options will depend on information that you did not provide in your posting. I am currently handling a similar action for someone else. It is unlikely that your desired outcome can be achieved without the assistance of an attorney.

There is no mystery answer that you need to pay for. Either work it out, or file a partition action requesting a court order to sell. This is an expensive process, and often eats up any equity, so do all you can to resolve it first. If you need to file a partition action, see an experienced real estate lawyer who primarily handles real estate disputes - not one who claims to handle cases in any area of law. A lawyer in the county of the property (or close) is a better option. For the benefit of other readers, this scenario comes up all the time here. A house as your primary commitment is rarely a good idea.

You can file a Petition to Partition. This is tricky and you don't want to try it yourself. Consult with a local attorney.
