if you don t know you have become tenants in common can you go to court for justice after you have live there paid mortgage, repairs upkeep property and all expenses and after 15 yrs you cant get the majority of proceeeds from sale of property

You are entitled to reimbursement for one-half of your expenditures for debt service, taxes and insurance; but it may require a court ruling to get it. You should consult an attorney.

I think you may have confused your terms. I don't know of anyone becoming a tenant in common without his/her knowledge. You should have an attorney located where the property is located to review all of the facts and documents and apprise you of the situation.

I just concluded a similar case on Thursday. You may have to file a partition complaint to seek money. You will be credited for expenses you have spent on the property, but the out-of-possession owner will make a claim for rental value of the property. You need an experienced real estate attorney.
