Who's at fault for damage to a ''Gator?''

My son (15) was involved in an accident on a John deer 4X2 ''Gator,'' a vehicle with a flat bed back - sort of a tractor. The owner's teenage son (15) and my son were in it (my son was driving) and the Gator flipped over when the owner's son grabbed hold of the steering wheel on a public neighborhood street. No doubt my son was somewhat to blame, and we believe paying $500 - or the amount of most deductibles - is a fair settlement. However, the owner of the Gator believes we should pay the total cost of the repairs - $1438, which he has already performed without notifying us (or obtaining competitive bids.)

My questions are these: Is the owner liable for the damage because he should not have allowed these these teenagers to drive this vehicle unsupervised? Is this vehicle even ''street legal?'' If it goes to court, what are my chances that the judge will side with us?

Unless your son was speeding or otherwise driving wrecklessly, I think a judge would rule in your favor against both the owner and his son.
