Legal Question in Real Estate Law in Georgia

Forclosure and dismissed bankruptcy

My husband filed for bankruptcy because our home was about to be foreclosed and did not attend any of the hearings and his case was dismissed how quickly will the foreclosure proceedings begin again or what are all the bad things to come? And what can be done? If you can give me as much information as possible that would be wonderful.

Re: Forclosure and dismissed bankruptcy

It could be as soon as 6-8 weeks depending on the timing of the dismissal. They will likely have to advertise again, for 4 weeks prior to the foreclosure day the first Tuesday. You should check the appropriate paper for ads, and of course watch your mail for any notices. Another bankruptcy may be an option, if you are willing and able to attend the meetings and catch up your payments over time (in addition to your regular payments), especially if there is equity in the property. However, in the long run, it will not help you to file again just to delay a foreclosure if you are unable to do these things. The creditor will likely get an emergency order from the court to allow the foreclosure. Good luck with it.
