Legal Question in Real Estate Law in Georgia
I have a friend who was purchasing a property from a couple over 10 years ago, then the couple died. The couple owned the property outright and had a bank escrow for collecting the money. My friend and he husband continued to pay the escrow at the bank until my friends husband died two years later. Her husband handled all of the finances, so my friend did not have the least idea what to do.(not understanding financial matters) She waited to be billed for payment, and never got any billing...just to pay taxes on the property, which were in her name. She has been paying the taxes each month, and upkeep on property, and utilities...but no house payment...it has been over ten years now....Can she obtain a title on this property since she has never been billed for anything but taxes? As I said, the couple selling it to them owned it free and clear. Its a condo.

If she bought the property properly, there was a deed and a mortgage. That neans she owns it, but she owes, and you don't wait for a bill - you pay the mortgage regardless. If she's 10 years delinquent she needs to catch up as she is at severe risk for foreclosure.
