Georgia Squatters Legal Rights

We have been maintaining a portion of land next to ours that belongs to the subdivision. There is nothing on it and it is in flood plain. This makes our property a square instead of a triangle. We are now wanting to fence the property. Do we have any legal right to fence the protion belonging to the subdivision also? We have been mainting the property for 8 years.

By your own statement, the property belongs to the subdivision. Therefore, you can't claim it. However, you can probably work out an easement or a sale of worthless property for $1.00 or somesuch. Talk to the board and a local attorney.

You would be unwise to claim someone else's property as your own, prior to taking the necessary steps toward obtaining the right to do so. Moreover, you might incur unanticipated liability for debts and/or liabilities related to the property.
