Can I build a house on Heir property if I have a 2/5 share in the Property 0f 31 acres?

No. You own 2/5 of the WHOLE 31 acres but someone else owns 3/5 of the WHOLE thing. You must reach an agreement with the other owners as to WHICH approximately 12 acres you get. You should consult with a local attorney about a Petition to Partition.
