Legal Question in Real Estate Law in Georgia

Heirs Property

My mother is one of several people who inherited property from my grand father. However, over the last 13 years she has been the only one to pay taxes on the property. She wants to put the land up for sell. What can she do?

Re: Heirs Property

What your mother can do will depend on information that an attorney will need to discuss with her. She should consult an attorney before moving forward.

Re: Heirs Property

Unless she can get all of the heirs to agree to sell, and to reimburse her for her payment of taxes before dividing the proceeds, she will need to file a partition action in superior court. Either way, she should consult an attorney to protect her rights.

Re: Heirs Property

She should see if the other heirs will enter into an agreement to reimburse her for their pro rata share of the taxes. Consult with an attorney.
