Legal Question in Real Estate Law in Georgia

Hello,

I just received a letter from my neighborhood association stating that those who are late with their dues will have a lien placed against their home. My family is struggling financially at the moment and we have no other choice than be late therefore we are subject to the lien. I was wondering what does having a lien filed against your home mean and since I will have paid the dues by the time they file it how do I remove it.

The filing of a lien against your property doesn't really mean anything unless you are trying to either sell or refinance, in either of which cases it would have to be paid off. If you pay the dues after they have filed a lien, they should give you a release, which you can file at the courthouse for $5.00. If you pay before they file, there is no reason for them to even file a lien.

If you pay after they have started the process, you will be expected to pay not only the dues and late fees, but any fees associated with the cost of the lien. That includes attorneys fees. Check your paperwork. In many cases, the additional fees can exceed the dues by a significant amount.
