Legal Question in Real Estate Law in Georgia

HOA deed question

I am on the board of directors of my Homeowners Association. We have recently taken the association over from the developer who left us with a mound of mess. One of which is a tax bill for our amenities area from 2005. My question is, we have just found out that he has just changed the deed from his business name to the associations name. Will this help us at all in trying to make him pay the past due taxes?

Without having all of the information available, as I would if I were employed to investigate this matter, it is difficult to answer your question with any degree of certainty.

Based on the facts that you provided, your developer may have evaded tax liability. My firm practices community association law. Please call me in the event that you are interested in retaining a firm to handle issues like this one.

If you have a mound of mess, this is a great time to retain a lawyer of firm who REGULARLY practices in the area as a primary practice. If they hold themselves out as practicing in this and a dozen other areas, take that into consideration. There are several qualified firms in Atlanta, and no doubt other areas. This is a lawyer you will be using from time to time, so don't waste time by retaining a lawyer who looks for fees in many unrelated areas.
