Legal Question in Real Estate Law in Georgia
hoa dues public listing homeowners in default
is it legal for hoa presidents/assistants to make a list of homeowners who are in default/late with hoa payment/s and place the list in everyones in the subdivisons mail box without consent of the property management company or homeowner-- this happen to me and i wasn't in default it was a typing error-miscommuncation. This list is attached to a monthly hoa news letter from hoa president in subdivison use to embarrass those who are not paying-without knowing if the information is true. can i sue... do i have a case?

I represent HOAs. I doubt you would have much of a case because all humans make mistakes. However, you at least have the right to demand that they take corrective measures in the next newsletter.

If you are interested in preserving your reputation, you could ask the hoa to print a retraction in very large type in a future newsletter.
