Legal Question in Real Estate Law in Georgia

Hoa

I purchased a home In Georgia last August. There was no mention of a HOA. I still to this day have not revieved a copy of the rules and regulations. I was unaware one exsisited until I got a bill in June, almost a year after moving in that there was one and I owe 250.00.

Since it was not mentioned at closing am I responsible for paying and being a member? What are my rights?

As a real estate attorney, I would need to examine your contract, closing documents and research public records in order to answer your question. Please feel free to contact me in the event that you wish to employ an attorney to assist you.

Re: Hoa

You fail to mention what is filed in public records, of which you are charged with knowledge. You don't need to pay a lawyer to review your closing file, and you review public records as www.gsccca.org. Also, ask the HOA rep for additional information. It is unlikely you come out ahead by paying a lawyer to review all these documents, at a cost higher than the bill, but if you need a lawyer, ask for referrals for a lawyer who primarily practices real estate law.
