Legal Question in Real Estate Law in Georgia

Home builder failed to repair problems identified in walk through before closing

Bought house July 10, 2003. Some 18 items identified to builder/seller before closing. Nothing done. Called many times - no return calls. Sent certified letter. No response. Closing atty became angry and sent letter to builder. No response. Checked with BBB and magistrate. Others have had problems with this guy. Have gotten estimates from others to do repair work. Totals $2500 - $3000. I'd be willing to pay for it myself if we can put this guy out of business, or at least get an injunction to stop him building more until he completes the pending work. What are my options?

Trying to get an injunction is a creative way of looking at the situation. You will need to file suit in the county of his residence. I would suggest you consult with an attorney there to see if he/she feels a local superior court judge would be receptive to this.
