New Home Contract and Drain Culvert
My wife and I signed a contract for a lot and a custom home on 07/14/2005. The lot is in an established subdivision that is finishing the final phase. The original close date was set for 11/30/2005, which was not met. An extension was set in place for 01/31/2006. The developer has just moved a drain, (after the extension was signed), from one property to ours without any authorization from the builder who owns the lot, or me. Not only has he moved the drain but placed a junction box at the front of the property. The drain was placed about 8 feet below existing grade level which means we will loose a lot of land functionality because of grading necessary to divert any water. I feel this has degraded the value of the property significantly. None of this was placed in the contract. What are our legal rights?

You need to have your contract reviewed ASAP by a local attorney. There are too many questions that can't be answered in this type of forum.
