Legal Question in Real Estate Law in Georgia
Home We Gave Up
Due to financial difficulty, three years ago we were forced to give our home away. This was in order to avoid foreclosure. The company that took the house told us they would be fixing it up, and selling it. Obviously we didn't get anything out of the deal and they caught up the loan have been making the payments, most of which were on time. That was three years ago and the house is still not sold. They have been renting the home. What rights do we have in order to get the house sold and our name off the deed? When these people miss payments or are behind, I am called as the house is still in my name. Thank you for your help and advice.

Re: Home We Gave Up
I would need to see the terms of your contract to see what your rights are. You should have some time provisions in the contract. If, not the contract might be voidable. To get your name off the note they will have to sell the house or refinance it.
