Legal Question in Real Estate Law in Georgia

Our home was illegally foreclosed on in Jan. However we have still been living in the home since then, trying to negotiate with them. They have mail sent to our home in their name. They have said in many court letters the home belongs to them and we are "refusing" to leave. They have sent us a reinstatement letter but they want all the months back payments. Can they make us pay that money if they say they own the home?

If you borrowed money and signed a contract, then yes you may owe a deficiency for the difference between what you owed on the loan and what they can get for the house. Can they "make" you pay? Yes, if they get a judgment and are able to garnish accounts or wages. There are too many unknowns, including what appears to be a court case. If they do get a judgement, then Bankruptcy is normally the only way out of a debt.

Apparently you are in a court case, dispossessory or foreclosure and are improperly responding. You needed a lawyer a long time back. You may or may not be too late now.
