Legal Question in Real Estate Law in Georgia

home inspector damaged our property

Is the home inpector and buyer's agent liable for damage done to our home during an inspection on our house when we were under contract? I came home to a 4ft. water stain in our family room ceiling. We have lived in the house for 12 years and never had a leak. He turned on all the faucets in the house and filled up the bath tub and started to let everyting drain at once. A contractor and plumber said he overflowed the drain system. We have been using the shower, toilet and bathtub at least three times a day since and there is no leak. They are refusing to pay for repairs.

Re: home inspector damaged our property

People are generally liable for the damage they cause. If the inspector was negligent and cause damages, a claim may be made. If there was a problem with your plumbing, anf the inspection merely uncovered the flaw, you may not have a claim. Where your case falls, we do not know.
