Legal Question in Real Estate Law in Georgia
Homeowner Association Question
At the annual hoa meeting, the present board said they would stay on in addition to the 2 new board members. But by-laws state members can only serve 2 years. We need 3 board members, when 3 residents volunteered the current president stated ''we'' want an odd number on the board, so 1 person stepped down. What can be done to rectify this, does the court have to get involved, will it cost anything?

Re: Homeowner Association Question
The answer should be found in your covenants and/or by-laws. These vary from subdivision to subdivision. Consult with a local attorney.
Re: Homeowner Association Question
You should have the by-laws amended by whatever vote is necessary to change them.
