Legal Question in Real Estate Law in Georgia
Homeowner
The Lawyer Agent for the Homeowner's Associaton of my subdivision sent documents titled ''Consent Judgment on Outstanding Assessments''. The verbiage states ''Please find attached the Consent Judgment documents that I will need you to sign. The Consent Judgment will not be filled with the Court, unless you fail to abide by the payment schedule in the Consent Judgment.
He wants me to sign a blank document (which I refuse to do under any circumstances) that
1) I consent to him filing a judgment against me if I don't pay.
2) The actual agreement of payment of $50 a month for 9 months as Exhibit A
3) Waiver of Notice and Acknowledgement of Service
Is this common practice for lawyers to strong arm property owners into giving them their property?
Is what he doing Legal?
How should I deal with them regarding payment being that I refuse

Noticeably missing from your post are any facts whatsoever concerning the underlying dispute or your HOA agreements, so your last question cannot be answered (unless the answer is to see a lawyer to discuss). The lawyer is offering a settlement - of course, it is legal to offer to settle. You choose whether to accept. They may take further action if you do not.
