Homeowners Associations

Hello!

How do you fight a homeowners association?

First, let it be said that I understand & have lived in subdivisions w/ homeowners fees. I understand the pupose/value.

We bought a house last year not realizing there were homeowner assoc. w/dues. There are no pools, no tennis, no playgrounds and no sidewalks. We only have street lights, a entrance and grass cutting on a flood rention pond field. There are a total of 81 homes times $200 a yr....that's a lot of money ($16,200). I called GA Power myself and the street lights are only $4500 per year. The grass cutting can't be more than $200 a month. So several of us are wondering where all the money is going?

Now they want to raise the homeowners fee another $100 for 2006 and $400+ for 2007. The news letter states that if no one wants to volunteer to become president that they will have to ''hire'' a management company and then they said we will still need officers.

Can they really do this? I thought it had to be voted on by the all homeowners. What if those of us who strongly disagree simply don't pay? Can they really put leins on the house? Please tell me there is something we can do other than selling our home!

You need to request copies of all the relevant documents, including covenants and by-laws. That will, or should, answer many of your questions. We can't speculate about that.
