Legal Question in Real Estate Law in Georgia

My husband and I bought a home 18 yrs. ago. He took out a 2nd mortgage. We have acquired a modification on the first and tried with the second but they are starting foreclosure. Can they foreclose with both names on the deed but only his name on the 2nd mortgage?
