Legal Question in Real Estate Law in Georgia

my husband and I have been under contract to buy a foreclosure since september 2010. the original close date was november 19, we've signed several extensions since. the seller keeps having issues with the deed and power of attorney, it's just been one thing after another. our real estate agent is claiming we have to sign a termination and release agreement to get out of the contract. though it seems to me if we just refuse to sign another extension that the seller would be in default of the contract and it would be over due to contract expiring. we've put some money into this home through appraisals and power and water and inspections so my husband does not want to release the seller from responsibility. so I was hoping you could tell me if we're required to sign the release or not
