Legal Question in Real Estate Law in Georgia
My husband and me live in a house co-owned by her brother and her.They charge us no rent,but we pay all of our own utilities and exenses.The problem is:they want to control every aspect of our being here.If something gets spilled on the carpet,they complain.If we are out late and come in late(even if are quiet) they complain.If we are on the phone when my grandmother calls and do not answer--keep in mind WE PAY ALL OF OUR OWN UTILITIES--If we do anything that they don't like, even if it does not pertain to the house, they complain!Now we are no longer allowed to have company because my grandmother has taken a general disliking to a couple of my friends,we are not allowed to have company over at our house.I am not wrinting to inquire about my rights, but in an argument my grangmother told us if we want freedom to MOVE.I'm waiting for her to get hateful adn force us to leave.How long do we have to move out, seeing as we do not pay rent or have any written agreement?I am not askig about what the process is.I know legally she may have to go to court to accomplish this.I need to know the time frame.

If there is no lease you are tenants and will and can be given 60 days notice to vacate. I
Acting out of spite (i.e., "waiting for her to get hateful...") and forcing her to file a disposessory action will get a lawsuit and perhaps even a judgment on your creditor report. That will affect you long after you are gone from this house. She is right - if you don't like the rules of the house -- someone else's house you are basically living in for free -- you can move. Handle it like an adult, and avoid any court filings for these personal spats that will only hurt you.
