Legal Question in Real Estate Law in Georgia
Husband wants mortgage in his name
I bought the house myself when single, then refinanced with my new husband in order to get a new mortgage. Now his name is on the deed. He wants to refinance again under his name only so we can get a lower interest rate, since his credit is better than mine. Will this adversely affect my financial interest in the property in the event of a divorce?

As long as your name remains on the deed, you should be OK. However, I doubt that, if your name is on the deed, a lender will approve a loan unless you sign on it also. Check with a local real estate attorney for more details.
