Legal Question in Real Estate Law in Georgia

lake property rights

i own a 6 acre lake. there are other lots on the lake

the survey stakes on all the lots are 6 to 8 ft from the water edge if someone buys a lot, can they use my lake

the lake is 30 yrs old with only 3 houses on it

i have owned it for 12 yrs. also does the property line go across the water as in some small curves in the lake or does it follow the shore line. does the new property owner have the right to clear the brush between the property stake and the water. all the stakes are metal rods and have been there for years

thanks

Re: lake property rights

Without seeing the survey, the pins or deeds, based on what you have said, I do not see any right of the other property owners to either use the lake or to clear brush that is not on their property. I think you should consult with a local attorney who can review the documents. If you would like to call me to discuss, please feel free to do so. I also live on a small lake, but my situation is somewhat different from yours. 770-987-6151
