Landlord responsibility to tenant for damages to tenant property

In a residential home where the basement is converted into an apartment and the landlord lives upstairs, is the landlord responsible for damages to tenant property when lanlord floods tenants living room with 100 gal of water originating from her toilet upstairs?

In a word, yes.

Though it is just an accident, landlords are generallyresponsible for their plumbing to be kept in good condition.

However, there can be legal lease terms which would 'shift'the risk -- i.e., remove landlord's liability, but such thingsare often not available in residential landlord/tenant law. You ought to consult a local attorney, perhaps a legal aid services organization since they're often best at this area oflaw and can be free or damned near free.
