Legal Question in Real Estate Law in Georgia

landlord restriction on appliance placement

I recently moved into an apartment, and

brought along a refrigerator that I own.

There is already a refrigerator in the apartment,

and my own refrigerator will not fit through the

doorway into the kitchen. Because of this I placed it in another (carpeted) room.

The landlord wants me to remove it from the premises, because he is uncomfortable with having it in a carpeted room. Can he place such ex-post

restrictions on where I put it? I gave

the landlord a substantial security deposit prior to moving in, and have assured him that, in the event of any damages, he may deduct them from the deposit. I have a 1-year lease.

Any response we give is subject to the legal terms stated on our web page.

Your lease (at least most GA form leases) do not specifically address your issue. However, if you were leasing from one of my clients and I really (note the emphasis) wanted you to move it, I probably could force you to move the Refrig. based on standard form language.
