Lease Deposits

I intended to move into a rental home and gave the Landlord a check for the first month's rent to hold a place for me until I signed a lease. She deposited the check before I signed a lease. Five days later I decided to not rent the house. She is refusing to return my deposit. Is she obligated to return this money to me?

Yes she is. Talk your local magistrate court about what action can be taken.

An "yes" or "no" would be nothing more than a guess, since you obviously do not post sufficient facts or the terms of the agreement. Do you contend that she had an obligation to hold the property, yet you had no obligation whatsoever? She likely would not say that was the agreement, since that was no benefit to her to do that.
