Legal Question in Real Estate Law in Georgia

Lien placed on my father's property when the debt is mine

My parents are in the process of buying a new home but are not able to close since there is a lien on the property they own now.

I had a car repossessed 5 years ago and I have yet to make an arrangement the the law office/collection agency. They are the ones that put the lien on my parents because my father and I have the same name. My father's info was no where on the original paperwork. How can I get this lien taken of my dad's property and prove that the debt actually belongs to me. My credit report clearly shows that the car was mines. Please help.

Re: Lien placed on my father's property when the debt is mine

You are probably going to have to threaten to sue the law office/collection unless they accept reasonable proof that you and your father are two different people. Consult with a local attorney. You and your father are not the first father-son duo to have the same name and this should not be that difficult to unscramble. However, get ready for resistance.
