Hello,
I hope someone will be able to answer my question or help me. I refinanced my house in December of 2005. When you pay for a title search if there is a lien against the property would they not have to tell you so? Basically the paperwork I have say's there are no liens. Now I am trying to get a second mortgage to do some remodeling on my home. The loan officer has informed me that there is indeed two liens against my home from, 2002 and 2003. Two different creditor liens. I don't understand how that could be, if the mortgage company I refinanced with did a title search and everything came back clear before they would give me the loan. I filed bankruptcy chapter 7 in 2003 and it was cleared in 2005. These two creditors that applied the liens(which I did not know about) were included in the bankruptcy. How do I get them removed so I can get my second loan? And is the mortgage company that I refinanced with held liable for anything, being they did the title search (that I had to pay for) and said every thing was clear that there were no liens, no judgements, etc against my home.

We have no idea what the liens are, and cannot speculate about them or what a title search revealed or did not reveal. Your first place to start is probably your bankruptcy lawyer.
