Legal Question in Real Estate Law in Georgia

Lien on Real Estate

My husband and I divorced and I was awarded the house. I now have a contract to sell it and have found out that there are 5 liens against the property in his name. How do I handle this? If unable to do anything about the liens, are they entitled to more than his interest in the proceeds?

Re: Lien on Real Estate

You need to have the entire situation reviewed. Consult with a local attorney.

Re: Lien on Real Estate

There is a lot of missing information that could be relevant, such as dates, who had title before the divorce, etc. If the liens are valid, it is likely they will need to be paid at closing and you can pursue him for the money. However, much like a sale of real property, this is something that should have been checked during the divorce process.
