Legal Question in Real Estate Law in Georgia

marital property or not

If a home was purchased 7days prior to the marriage, only the name of one partner is on the mortgage and only that one partner's credit was used to obtain the mortgage loan, would it still be considered marital property? The spouse who's name is not on the mortgage lived in the home 3of the 4 year marriage, left of their own free will refused to pay any bills associated with the house for the past year. Is the spouse that left still entitled to half the equity?

Re: marital property or not

The non-owner spouse might be entitled to some compensation for whatever expenses were shared (particuarly if they contributed to any increase in equity), but not to an automatic half of the equity.
