Legal Question in Real Estate Law in Georgia

Mortgage refinance

I closed on a refinance Nov 1 and funds were to be dispersed Nov 6. On Nov. 8, I was told by the mortgage company that they did not have proper paperwork and that I had to re-close. Is that legal or are they bound by the original closing documents?

Re: Mortgage refinance

We do not know what the original documents provide. Most likely, they contain a duty to correct or amend any errors.

Re: Mortgage refinance

It is impossible to advise you without reviewing the closing documents. You may want to have someone look at the next set of closing documents to assure that none of your terms are being changed to your detriment.
