Legal Question in Real Estate Law in Georgia
My mother is receiving money to catch up her mortgage from a government agency to prevent foreclosure of her house. To insure that the money is used for the intended purpose the government agency is sending a check directly to the mortgage company. The mortgage company is refusing payment because the want the money in the form of a western union quick collect or money gram. Can they refuse the payment if the government agency sends the check anyway. Are they legally able to refuse payment and send the check back.
