Legal Question in Real Estate Law in Georgia

I moved into a house in Feb. and was given a 2 year lease that I havnt signed or given back yet due to the landlords agreement to fix the things wrong with the house. He has fixed the counters but nothing else. I have contacted him a few times but hes only showed up unexpectedly to collect the rent when we were in bed and my husband forgot to get a receipt (just for this last month). My 2 children have been getting sick and I recently found black mold in the house. Is it okay for me to move right away and ask for my deposit back without haveing to pay anything if he takes me to court?

You moved into a home and paid a deposit without signing a lease? I cannot fathom someone doing that.

When no lease is signed, you are a tenant from month to month. That means you can move with 30 days written notice. Be sure to mention that no lease was signed. Your deposit, however, will likely be lost.
